What Sharkspan Is, and What It Is Not

Sharkspan shows you the time between now and a number that you set, and subtracts the time you record as already spoken for. That is the whole of what it does.

Sharkspan never predicts when you will die. It makes no estimate of any kind about your life expectancy. Every figure it displays is arithmetic on numbers you entered yourself. The number the picker starts on is a fixed starting position, the same for everyone; it is not an estimate about you, and nothing is saved until you confirm a number of your own.

The figures are illustrative and motivational only. They are not an actuarial, medical, or psychological assessment. Nothing shown in the app constitutes medical or mental-health advice, and nothing in the app should be treated as such.

The app is intended to encourage reflection on how you spend your time - not to cause worry. If anything shown in the app causes you distress, or if you are experiencing anxiety, depression, or thoughts of self-harm, please stop using the app and seek help from a qualified medical or mental-health professional. Never disregard professional advice, or delay seeking it, because of anything displayed in the app.

To the maximum extent permitted by applicable law, Monoshark accepts no liability for any decision you make, or any harm you experience, in reliance on the figures or other content displayed in the app.

Licence

By downloading or using the app, these terms automatically apply to you - please read them carefully before using the app. Monoshark grants you a limited, non-exclusive, non-transferable, revocable licence to use the app for your personal, non-commercial purposes on Apple-branded devices that you own or control, as permitted by the Apple Media Services Terms and Conditions. You are not allowed to copy or modify the app, any part of the app, or our trademarks in any way. You are not allowed to attempt to extract the source code of the app, translate the app into other languages, or make derivative versions. The app itself, and all trademarks, copyright, database rights, and other intellectual property rights related to it, belong to Monoshark.

By using the app you confirm that you are legally capable of entering into these terms, or that you have the consent of a parent or guardian.

Monoshark is committed to making the app as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you are paying for.

Quotes and Attributions

The app may display quotes, sayings, and slogans attributed to various persons, living or historical, famous or not. These are provided for motivational and informational purposes only. Their display does not imply any affiliation with, or endorsement of the app by, the persons quoted or their estates. While we try to attribute quotes correctly, we do not guarantee the accuracy, completeness, or correct attribution of any quote. Any third-party rights in the quoted material remain with their respective owners.

Your Data

The information you provide in the app is retained only by your device. Monoshark keeps no copy of it and cannot restore it. If you delete the app, or use the app's own start-over command, that information is gone. If you lose or replace your device, it comes back only if your own device backup holds it; keeping such a backup is your responsibility. It is also your responsibility to keep your device and access to the app secure. We therefore recommend that you do not jailbreak or root your device, which could make it vulnerable to malware, compromise its security features, and could mean that Sharkspan won't work properly or at all.

Limitation of Liability

The app is provided "as is", without warranty of any kind. While we strive to keep the app correct and reliable, to the maximum extent permitted by applicable law, Monoshark accepts no liability for any loss, direct or indirect, that you experience as a result of relying on the app or on the data recorded in it, including loss of data. Nothing in these terms excludes or limits any liability that cannot be excluded or limited under applicable law.

Apple App Store

The app is distributed through the Apple App Store. You acknowledge that these terms are between you and Monoshark, not Apple; that Apple has no obligation to provide any maintenance or support for the app; and that Apple is not responsible for addressing any claim by you or a third party relating to the app, including any product liability claim, any claim that the app fails to conform to a legal or regulatory requirement, any consumer protection claim, or any third-party claim that the app infringes intellectual property rights. In the event of any failure of the app to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) that you paid for the app; to the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the app. When using the app, you must comply with any applicable third-party terms of agreement (for example, your wireless data service agreement). Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

You represent and warrant that you are not located in a country that is subject to a United States Government embargo or that has been designated by the United States Government as a "terrorist supporting" country, and that you are not listed on any United States Government list of prohibited or restricted parties.

Governing Law

These terms, and any dispute arising out of them or out of your use of the app, are governed by the laws of Ukraine, and the courts of Ukraine have jurisdiction over such disputes. If you are a consumer, you additionally keep the benefit of any mandatory consumer-protection rules of the country where you live, and nothing in this clause deprives you of them.

Severability and Entire Agreement

If any provision of these terms is found invalid or unenforceable, the remaining provisions remain in full force and effect. These terms, together with our Privacy Policy, constitute the entire agreement between you and Monoshark regarding the app.

Availability and Changes

We may stop providing the app, and may terminate its use, at any time and without notice to you. Unless we tell you otherwise, upon any termination your rights under these terms end, and you must stop using the app.

We may update these Terms & Conditions from time to time. You are advised to review this page periodically for any changes, which we will post here.
